The SAGITINE website is operated under license by Sagitine Pty Ltd (ABN No 51166484608) whose registered office is located at: 30 Darling Street, Bronte. By accessing and using the Sagitine website, you are consenting to the terms and conditions of this site as well as the collection of information. Sagitine Pty Ltd endeavours to keep the information on the Sagitine website up to date, however it may contain errors and inaccuracies and may not be current at time of viewing. The Terms may be updated by us from time to time. Any changes to our terms of use will be posted here. Your continued use of the services and Websites will amount to acceptance of any updated Terms.

Terms Of Sale

If you are purchasing items through the Website, you agree that these Terms apply to each order you place. If you are entering into these Terms on behalf of another entity, you do so representing that you have the authority to bind that entity to these Terms. If you do not have the authority or do not agree to these Terms, you are not permitted to use the Website or services. Sagitine reserves the right to accept or decline orders made through the Sagitine Website. All orders are subject to availability and confirmation of the order When you place an order, you’ll receive an acknowledgement e-mail confirming receipt of your order; this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we confirm to you that your goods have been dispatched. Occasionally, certain goods may be out of stock or be subject to long lead times. The estimated lead-times are an approximation only and are subject to change. If we are unable to fulfil your order, we will either refund you the price of the goods or provide you with a credit note.

Pricing

All prices listed on the website are in Australian Dollars unless otherwise specified. The currency conversion is an indication and may not be correct at the time of purchase. All orders will be charged in AUD. Delivery costs may be charged in addition to the product price. You’ll be asked how you’d like your goods delivered during checkout. Sagitine reserves the right to alter, update or change the pricing of any item available on the site at any time

Pre-Orders

All pre-order Products are subject to deposit payment of fifty percent (50%) of the total amount at the time of order, exclusive of shipping fees and taxes. We will charge the remaining fifty percent (50%) of the amount due, plus shipping fees, and any taxes or duties owed as the Product is ready for shipment. As soon as the preorder has been placed it cannot be cancelled. Any delays, production changes, or cancellations will be communicated to the customer as soon as it is confirmed by the manufacturer. Any other cancellation requests are at the discretion of Sagitine, and may only be refunded as Site Credit. PAYMENT Sagitine accept online payments from all major credit and debit cards, Paypal, Afterpay, Apple Pay and Google Pay. All payments will be processed in AUD.

Discount

Only one discount code can be used per order and is not redeemable for cash or in-store. Discount codes are valid during promotion time and cannot be used at a later date. Discount codes must be applied at the time of checkout. The code cannot be applied to any orders retrospectively. Products may be marked down at Sagitine’s discretion. Marked down prices cannot be applied to any orders retrospectively. Original pricing will be indicated with a strike-though alongside the current price.

Gift Cards

Your purchase, activation, use or attempted use of a Gift Card constitutes your acceptance of these Terms. If you are purchasing a Gift Card as a gift for another person, you should ensure that person is aware of these Terms including the expiry date of the Gift Card. Gift Cards are available for purchase online. When you purchase a Gift Card, you nominate the amount you want to put on the card (must be a minimum of $50.00) and pay that amount by any means other than by another Gift Card. Sagitine will collect personal information about you or the recipient of the Gift Card and create an account in the name of the cardholder which will be linked to the unique reference number of the card. The information Sagitine collects will include the purchaser and cardholder’s name and email address. The Gift Card will be valid for thirty six (36) months from the date of purchase. To redeem a Gift Card, please enter the unique reference number at time of checkout online. If your Gift Card exceeds the total amount of your order, the remaining balance will be automatically updated on your Gift Card. If your order exceeds the value of the Gift Card, you must pay the remaining balance of your total order amount by an alternative form of payment Sagitine gift cards are for use solely on the Sagitine website and cannot be redeemed in person or with any of our stockists. Gift Cards cannot be returned or exchanged for cash, nor can Gift Card balances be transferred to a new Gift Card.

Delivery

Please refer to our Shipping policy. The Customer must inform Sagitine of any issues, difficulties or specific requirements associated with the delivery of the products and must ensure that the item ordered is capable of delivery. I.e through doorways and up staircases. Someone aged over 18 must be present and able to accept the delivery at the delivery address supplied by the customer. Unforeseeable circumstances may impact delivery within the agreed timeframe. Risk and liability in goods passes to you at the time of delivery of the Goods to your nominated address. Regional or International customers can nominate their own transport carrier and pay all associated charges and insurances direct to that carrier. Liability in goods passes to the carrier at the time of delivery of the Goods to your carrier. Your order will not be dispatched until we receive cleared funds. If your payment does not clear or is declined then we will not dispatch your order and no contract will have been formed between us for the supply of goods. Please note that you are considered the importer of products and must comply with all laws and regulations, including any import duties and/or taxes of the country in which you are receiving the products.

Returns

Please refer to our Returns Policy. Unless otherwise specified, we do not offer returns for a refund on any discounted product, unless faulty or damaged. This includes marked down items, sale products or items discounted through marketing/promotions/code discounts. Exchanges, subject to stock availability, can be processed for sale orders - and where applicable credit notes can be issued for sale returns.

Product Warranty

Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure.

Intellectual Property

Sagitine is the owner or the licensee of all intellectual property rights on the website, and in the material published on it. Such works are protected by copyright laws and treaties around the world. All such rights are reserved. You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors. All intellectual property of Sagitine Pty Ltd such as trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of the website remain the property of Sagitine Pty Ltd. By using the Website you agree to respect the intellectual property rights of Sagitine Pty Ltd and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the website. All infringements of Sagitine Pty Ltd intellectual property rights will be prosecuted to the fullest extent of the law.

Fair Trade Policy

Integrity is an essential part of what we do at Sagitine. We source a diverse mix of product from around the globe and trade with a variety of manufacturers. It’s important to us that we build fair and positive relationships with our suppliers and their employees. Whilst cultural norms will vary from nation to nation there are certain standards, which we believe cannot be compromised. We do our utmost to ensure that we are working within a fair trade environment as outlined in the points below.

• All employees must receive fair wages that are in line with similar occupations locally.
• The price of the finished article should directly reflect the human hours put into its manufacture.
•  Employees should have protected conditions of employment and security in their jobs. There should be provisions for sickness to cover loss of earnings.
• Working hours should be reasonable to allow for leisure time. • We deplore the exploitation of children.
• We deal personally and directly with all our manufacturers and suppliers.
• Our manufacturers should employ a health and safety policy and all employees should be made aware of safety standards and the dangers of machinery and chemicals used in production. There should be a first-aid box and someone present trained to know how to administer first-aid. The premises should be electrically safe and not a fire hazard. There should be adequate exits for the number of employees present.
•  Drinking water and adequate sanitation facilities must be provided. 

Governing Laws and Jurisdiction 

This agreement will be governed by the laws of the state of New South Wales in Australia supplemented by all federal laws of Australia where applicable, and any user of the website hereby agrees to be bound exclusively by the jurisdiction of Australia courts without reference to rules governing choice of laws.
